1. Who you are contracting with
Symphony 100 operates through two entities. Which one you contract with depends on where you are.
| If you are in | You contract with |
|---|---|
| The United States or Canada | Symphony 100 North America LLC, a limited liability company formed in Wyoming, USA 30 Gould Street, Suite N, Sheridan, WY 82801, USA |
| Israel, the MENA region, or anywhere else | Symphony 100 Ltd., a company registered in Israel Company registration number 516786621 · Carlebach 4A, Tel Aviv-Yafo 6713229, Israel |
Symphony 100 Ltd. owns and administers the websites and all content on them, for both entities. In these terms, "we" and "Symphony 100" mean whichever entity you are contracting with, and "you" means the person or organization buying or using the services.
2. Accepting these terms
By buying from us, creating an account, enrolling in a program, or using our sites, you agree to these terms. If you are agreeing on behalf of an employer or client, you confirm you have authority to bind them, and "you" includes that organization.
If you do not agree, do not buy or use the services.
3. Eligibility
You must be at least 18 years old and legally able to enter a contract. Our programs are designed for working adults in professional settings.
4. Your account
- Give us accurate details and keep them current.
- Your login is personal to you. Do not share it. Each seat covers one named individual.
- You are responsible for activity under your account. Tell us immediately if you think someone else has access.
- We may suspend an account that appears to be shared, resold, or used to extract content in bulk.
5. What we provide
Depending on what you buy, we provide:
- Self-paced online courses, including video lessons, workbooks, and downloadable tools
- Assessments and profile reports under the Everything DiSC® and The Five Behaviors® product families
- Workshops, facilitation, and advisory sessions, delivered live or online
- Certification packages — seats in the publisher's certification programs together with Symphony 100 onboarding, planning tools, and support (see section 7)
- Assessment credits, bought one-time or under an annual credit subscription (see section 6A)
- Digital products — guides, templates, and reference materials
What is included in any purchase is what the sales page said at the time you bought it. We may improve or update course content; we will not materially reduce what you paid for during your access period.
6. Orders, prices, and tax
- Your order is an offer. The contract forms when we send an order confirmation or grant access, whichever comes first.
- Prices are shown in US dollars (USD) unless stated otherwise on the page. If your card is denominated in another currency, your bank sets the exchange rate and may add its own conversion fee — that charge is theirs, not ours.
- Prices exclude taxes unless the checkout says otherwise. Any VAT, sales tax, or equivalent is added at checkout based on your location, or is your responsibility where we are not required to collect it.
- Payment is processed by Stripe. We do not receive or store your full card details. Stripe's terms apply to the payment itself.
- Promotional prices apply only while published. Founding-cohort and early-access prices are limited and may change without notice; the price you paid is the price for what you bought.
- If a price is listed in obvious error, we may cancel the order and refund you in full rather than honor it. We will tell you promptly.
6A. Annual credit subscription
This section applies only if your organization buys assessment credits under an annual credit subscription. One-time credit purchases are governed by sections 6, 7, and 11.
- What the subscription is. An annual credit subscription is a twelve-month commitment by your organization to purchase a stated total volume of assessment credits, billed in monthly installments. Credits are what your organization's administrator account uses to issue Everything DiSC® and The Five Behaviors® assessments, profiles, and reports.
- Commitment and rate. The subscription rate depends on the annual volume you commit to and follows the volume-rate ladder advertised at the time you commit. The commitment total, the per-credit rate, and the resulting monthly amount are shown on the checkout page and in the package agreement before you pay, and those figures govern your subscription.
- Billing schedule. The first payment is due when your organization makes the commitment. Each subsequent monthly payment is due on the first day of the calendar month. Card payments confirm the same day; payments by invoice or bank transfer confirm when funds clear.
- Credits are released as each payment confirms. We deposit credits into your organization's administrator account within one US business day of each confirmed payment. We do not release credits ahead of a confirmed payment.
- Additional purchases during the term. Credits your organization buys during the term beyond the monthly schedule are priced at your committed rate and count toward the commitment total. One-time purchases made outside a subscription are priced at the advertised volume rate for their own quantity.
- Renewal and cancellation notice. The subscription renews for a further twelve-month term unless either party gives written notice of non-renewal at least 30 days before the renewal date. We will remind you by email before the renewal date. Your notice goes to the contact address in section 22; ours goes to the billing contact on your account.
- Stopped payments and re-pricing. If your organization stops payment before completing the commitment, credit deposits pause immediately. Credits already deposited are re-priced at the advertised volume rate for the quantity your organization has actually taken, and we invoice the difference between the committed rate and the re-priced rate. We issue that revised invoice within two business days of the stopped payment. This is an agreed adjustment of the price to the volume actually purchased, not a penalty.
- No cash refunds. Credits are non-refundable once deposited into your organization's administrator account, consistent with section 11. Payments already made under the subscription are not refundable in cash; paused deposits and re-pricing are the exclusive adjustment when a subscription ends early.
- Publisher terms apply on the publisher's platforms. Assessments, profiles, and your organization's administrator account operate on platforms owned and run by John Wiley & Sons, Inc. While your users are on those platforms, the publisher's own terms of use and privacy policy apply, not ours (see section 13). The checkout page presents the applicable publisher terms before purchase (see our Consent & Disclosure page), and completing checkout confirms that your organization has reviewed them. No assessment data is stored on Symphony 100 systems. Credits remain within your organization's own account structure and cannot be transferred to an unrelated organization.
- Account requirement. The subscription requires an administrator account in your organization's name. The person administering the account maintains their own Everything DiSC® on Catalyst™ profile, at minimum the base profile.
7. Refunds, cancellation, and the First-Session Guarantee
What we guarantee is your satisfaction, not your results. Results depend on you and your team doing the work — no course can promise an outcome, and we will not pretend otherwise. See our Results Disclaimer.
7-day money-back guarantee on self-paced courses. Get inside, see the full course, and if it is not right for you, email us within 7 days of purchase for a full refund. No questions asked. You do not need to justify the request, and looking at all of the material is not a reason for us to say no.
Different products carry different terms, set out in the table below. Assessments, learning portals, and certification are not covered by a money-back guarantee, because access is issued immediately and cannot be recovered.
Refunds are issued to the original payment method. How quickly the money appears is set by your bank or card issuer, not by us.
| What you bought | What applies |
|---|---|
| Courses (self-paced) |
7-day satisfaction guarantee from the date of purchase. Email us within 7 days for a full refund. No questions asked. |
| Online workshops | Fully guaranteed when you attend and participate. Email us within 7 days of the workshop for a full refund. The workshop must be held within 90 days of purchase. Because the guarantee is tied to attending, it does not apply where you did not attend or did not take part. Your seat can be rescheduled — see below. |
| Digital products (Everything DiSC® and The Five Behaviors® assessments, profiles, and learning portals) |
Non-refundable once access is issued. Access codes go live at checkout, so these are non-refundable from that point. Credits stay within your own account structure and cannot be transferred to an unrelated organization. See section 11. |
| Certification | Non-refundable, and access cannot be transferred to another employee at your organization. Attendance is required for all sessions. You may reschedule your certification in the Online Training Center as many times as you need to until your selected course begins — at that point you are locked into that date. Certification is delivered by the publisher, John Wiley & Sons, Inc., on their Online Training Center. The publisher's own terms and platform conditions apply to that delivery alongside these terms. Certification packages that include Symphony 100 onboarding carry the First-Session Guarantee below. That guarantee is continued service, never a cash refund, and it does not change the non-refundable, non-transferable character of the certification seat. |
| Custom packages | Carry their own terms, set out in the written proposal or statement of work for that engagement, which takes precedence over this section. |
- Where a purchase is made through an employer or sponsor, refunds are made to whoever paid.
If you are a consumer in the EU or UK
You normally have 14 days to withdraw from a distance contract. Digital content is an exception: by ticking the box at checkout to start immediately, you ask us to begin supply during the withdrawal period and acknowledge that you lose the right to withdraw once supply has begun. Our 7-day satisfaction guarantee is offered voluntarily on top of this, and applies once access has started — at which point the statutory right would otherwise be gone. Nothing here removes a right you have by law.
This matters most for digital products and certification, where access codes go live at checkout. That is why our checkout asks you to confirm, before you pay, that you want immediate delivery and understand what that means for the withdrawal right.
The First-Session Guarantee (certification packages)
Do the build-out with us — the admin course, your onboarding sessions, and your first-cohort plan. If after 90 days you're still not running your first session, we keep working with you at no additional cost until you are.
- Who it covers. Buyers of certification packages that include Symphony 100 onboarding, as identified on the sales page or package agreement.
- The three steps. The guarantee applies once your organization completes all three tracked onboarding steps: (1) your practitioner or program manager completes the self-paced administrator workshop; (2) your organization attends the scheduled onboarding sessions; and (3) your organization submits its first-cohort plan using the planning tools we provide.
- When it activates. If your organization completes all three steps and has still not run its first session by day 90 — counted from the date the package agreement is countersigned — we continue working with your organization at no additional cost until your first session runs.
- Participation is the condition. An organization that does not complete the three steps — including missed onboarding sessions or an unsubmitted first-cohort plan — cannot claim the guarantee.
- The remedy is continued service. The guarantee never provides a cash refund, and it does not alter the non-refundable character of certification seats, deposited credits, or issued assessments under these terms.
- Certification seats. Where a package includes the Everything DiSC® Certification Program, the seat is non-refundable, cannot be transferred to another person, and all live sessions must be attended. Checkout presents this before payment and asks you to confirm it — see our Consent & Disclosure page.
- Not a promise of results. This guarantee is a commitment of Symphony 100's continued services. It is not a promise of business outcomes, which are governed by our Results Disclaimer and section 14.
8. Access and license
- Course access is lifetime access. We place no time limit on your access, and you will not be asked to renew or re-purchase. "Lifetime" means the working life of the course, not yours or ours — see the paragraph below.
- We grant you a limited, personal, non-exclusive, non-transferable license to access the materials for your own professional development, and to use the templates and tools inside your own organization.
- You may not resell, sublicense, publish, share logins for, or use our materials to build or deliver a competing program.
- Downloadable workbooks and templates are yours to keep and use internally, permanently — including after any platform access ends. Video, platform-hosted content, and the interactive tools are not.
What "lifetime" honestly means
We are not going to promise you perpetual access and quietly rely on you never noticing if it ends. So, plainly:
Your access lasts as long as we offer the course. There is no expiry date on your account, no renewal, and no charge to come back to it. If we ever retire the course or cease trading, access ends then — because no business can guarantee access beyond its own existence, and any company telling you otherwise is making a promise it cannot keep.
If that happens, here is what we commit to:
- At least 90 days' written notice to the email address on your account before access ends.
- A download window during that period so you can keep the workbooks, templates, and tools.
- No refund is due at that point — you will have had the course for the period we offered it — but if we retire a course within 12 months of your purchase, we will refund you on a pro-rata basis.
This is also why the downloadable materials matter: those are yours to keep regardless of what happens to the platform or to us.
9. Acceptable use
Do not:
- copy, scrape, record, or redistribute course content
- share your login, or enroll one person and let several use the account
- reverse-engineer, interfere with, or attempt to gain unauthorized access to our systems
- upload anything unlawful, defamatory, or infringing to forms, comments, or shared spaces
- use our materials to train a machine learning model, or feed them into an automated system that reproduces them
- misrepresent yourself as certified, endorsed by, or partnered with Symphony 100
We may suspend or terminate access for a serious or repeated breach, without refund.
10. Intellectual property
All content on our sites and in our programs — text, video, graphics, frameworks, workbooks, assessments tools we author, and the Symphony 100™ name and logo — is owned by Symphony 100 Ltd. or licensed to it, and is protected by copyright and trademark law. Nothing in these terms transfers ownership to you.
Third-party marks
Everything DiSC® and The Five Behaviors® are registered trademarks of John Wiley & Sons, Inc. or its affiliated companies. Symphony 100 is an independent authorized partner and is not affiliated with, endorsed by, or a subsidiary of John Wiley & Sons, Inc. We are authorized to distribute and facilitate those products; the underlying assessment content, models, and reports remain the property of their publisher and are used under that authorisation.
Symphony 100's own frameworks, courses, and tools are separate works, created independently. Any reference to our facilitators' certification in third-party instruments describes their professional credentials, not the origin of our materials.
11. Assessments
- Assessments measure behavioral preferences at work. They are not clinical, diagnostic, or psychometric selection instruments.
- They must not be used to make hiring, promotion, compensation, discipline, or termination decisions. Using them that way breaches these terms and the publisher's own conditions, and may expose you to employment-law risk.
- Access codes go live at checkout. From that point the purchase is non-refundable and non-transferable — see section 7.
- Credits stay within your own account structure. Credits sit in the account they were purchased for. If you hold an administrator account you may create sub-accounts beneath it and allocate credits within your own structure. You may not transfer credits to an unrelated organization's account or sub-account.
- Account and credit provisioning runs through an authorized partner. New accounts, sub-accounts, and credit purchases are arranged through an authorized partner of the publisher — you cannot buy or move them independently of that route.
- We do not hold your assessment data. Responses and profile reports are never stored on Symphony 100 systems; they sit on the publisher's platform under the publisher's own security program and retention policy. An account administrator can generally remove a learner's profile from the account — for example when someone leaves your organization — and individuals can exercise their rights with the publisher directly. See Privacy Policy section 5.
- Tell your participants before you ask them to complete an assessment that their responses will be processed on the publisher's platform under the publisher's privacy policy. That is your obligation as the sponsor, not ours.
- Where you buy assessments for a team, you are responsible for telling each participant how their results will be used and for obtaining any consent your local law requires.
- Individual profile reports belong to the participant. Where you are the sponsor, you receive individual reports only where participants were told in advance and agreed; otherwise you receive group-level results.
12. Your content and feedback
Anything you enter into workbooks, forms, or shared course spaces stays yours. By submitting it you give us a license to store and process it so we can deliver the service.
If you send us feedback, testimonials, or suggestions, you allow us to use them to improve our services and, for testimonials, to quote you by first name and role in marketing — unless you tell us not to, which you can do at any time.
13. Third-party services
Our sites run on and link to services we do not control, including the checkout, course platform, video hosting, and calendar booking. We choose them carefully but we are not responsible for their availability or their own terms. Where a third-party outage prevents delivery, we will extend your access rather than treat it as a failure to supply.
Publisher platforms
Some of what you buy from us is delivered on the publisher's platforms rather than ours:
- Certification — the Wiley Online Training Center, learn.wileyworkplace.com
- Everything DiSC® on Catalyst™ profiles — catalyst.everythingdisc.com
- All other Everything DiSC® and The Five Behaviors® profiles — myeverythingdisc.com
While you are on those platforms you are subject to the publisher's own terms and privacy policy, not ours. You may need to accept their terms separately to get access. Where their terms and ours differ about the platform itself, theirs govern what happens there; these terms still govern your purchase from us.
14. No professional advice, no guaranteed results
Our programs are professional development and organizational training. They are not legal, financial, medical, or psychological advice, and no coaching or facilitation relationship creates a licensed professional relationship of that kind.
Team performance depends on factors we do not control — your people, your market, your timing, and what you actually implement. We describe outcomes other organizations have experienced. We do not guarantee any specific result, including any change in retention, engagement, or performance. Our full Results Disclaimer forms part of these terms.
This is the counterpart to section 7: what we stand behind is your satisfaction with the material, which is why the guarantee is a short window to look and decide rather than a long window to measure an outcome.
15. Availability and changes
We aim to keep everything running but do not promise uninterrupted access. We may perform maintenance, change features, or update content. We may change these terms; the date at the top shows the current version, and material changes will be notified by email or an on-site notice before they take effect. Continuing to use the services after that means you accept the change. Changes do not apply retroactively to a purchase you have already made.
16. Disclaimers and liability
The services are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if we were told such damages were possible.
Our total aggregate liability arising out of or relating to the services is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
17. Indemnity
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the materials, or your use of assessments for employment decisions contrary to section 11.
18. Termination
You may stop using the services at any time. We may suspend or terminate access if you breach these terms materially, if payment fails and is not corrected, or if we are required to by law. On termination, your license ends and you must stop using our materials, except for downloadable items you were entitled to keep. Sections 10, 12, 16, 17, 19, and 21 survive termination.
19. Governing law and disputes
| If you contracted with | Governing law | Venue |
|---|---|---|
| Symphony 100 North America LLC | The laws of the State of Wyoming, USA, without regard to conflict-of-law rules | The state and federal courts located in Sheridan County, Wyoming |
| Symphony 100 Ltd. | The laws of the State of Israel | The competent courts of Tel Aviv-Yafo, Israel |
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before starting proceedings, both sides agree to try to resolve the dispute in good faith by writing to the contact address below and allowing 30 days for a response.
20. Your statutory rights
If you are a consumer, you keep the mandatory rights of the country where you live, and nothing in these terms takes them away. Where a mandatory consumer protection in your country conflicts with a clause here, that protection wins for you, and the rest of these terms still apply.
21. General
- Entire agreement. These terms, plus the sales page for what you bought and any signed proposal, are the whole agreement between us.
- Order of precedence. A signed proposal or statement of work overrides these terms where they conflict.
- Severability. If a clause is unenforceable, the rest stays in force.
- No waiver. Not enforcing a term once does not waive it.
- Assignment. You may not assign these terms without our consent. We may assign them to an affiliate or to a successor in a restructuring or sale.
- Force majeure. Neither side is liable for delay caused by events outside its reasonable control.
- Privacy. Our Privacy Policy and Cookie Policy form part of your agreement with us.
